The guard could go in either place:
SessionManager.branch() — This is where the leaf pointer is set. Every caller of branch() would get the protection automatically, including branchWithSummary() and any future code that branches. The session manager owns the tree invariants, so it's the right layer to enforce that "you can't park the leaf on a toolUse entry when a toolResult child exists."
AgentSession.navigateTree() — Only protects the tree navigation path. If something else calls sessionManager.branch() directly on a toolUse entry (which already happens in the existing test for branch scenarios), it wouldn't be protected.
SessionManager.branch() is the correct place. It's the single chokepoint for leaf changes and the right layer to enforce tree structure invariants.

In tree-selector.ts, the tree hides assistant entries when:
assistanthasTextContent(content) === falsestopReason is stop or toolUse (so not error/aborted)hasTextContent only checks text blocks. It ignores thinking and toolCall blocks.
So an assistant message with only thinking + toolCall gets filtered out, same as toolCall-only.
It is shown only if it is the current leaf, or if it is error/aborted.

You mostly cannot repro it with /tree right now.
Reason:
thinking and toolCall blocks do not count as text.toolUse entries that are only thinking + toolCall are invisible unless they are the current leaf.That is exactly your case. So selecting the visible read line in tree usually selects the toolResult node, not the assistant(toolUse) node, which keeps the sequence valid.
With /tree only, repro is possible only if one of these is true:
assistant(toolUse) message contains a text block.assistant(toolUse) node is current leaf at the moment you open tree.Otherwise /tree cannot target the bad node. That is why you cannot reproduce it interactively even though the structural bug exists.
